Terms & Conditions

   
1. General Terms

a)     In these Terms and Conditions [and in The Rules] "TRFC" means The Real Fight Club UK Limited; "Member" means the member named on the Membership Application Form; "the Club" means the TRFC gym at which the Member applied for membership; "Home Club" means the TRFC gym the Member uses; "Contract" means the contract between TRFC and the Member subject to the terms and conditions of membership set out below, on the Membership Application Form, and in the Rules; "Membership Application Form" means the application form completed by the Member to join the Club; and "Rules" means the Rules of Membership set out in the TRFC Rules of Membership.

b)     The Club is a proprietary club owned by TRFC whose principal activity is to provide health, fitness and leisure facilities for Members and their guests.  TRFC has appointed a general manager at each club, who together with the management team ("the Management") is responsible for the operation of the relevant club in accordance with the terms and conditions of this Contract as amended from time to time.

2. Membership Application

a)     Membership is subject to the terms and conditions of this Contract as amended from time to time.

b)     Submission of a Membership Application Form is an offer by the Member to TRFC to become a member of the Club subject to the terms and conditions of this Contract.  Membership shall only be effective on payment of the Administration or Join Fee and where applicable, the advanced payment of the membership package and the Management reserves the right to reject any application for membership.

c)       Acceptance of an application for Membership of each Club is at TRFC’s absolute discretion (although TRFC will exercise their discretion reasonably and in compliance with applicable laws).

d)     All membership schemes are available to individuals of 18 years of age and over subject to status.

3. Membership Types

a)     ‘3 Months Pay Monthly’ memberships entitle the Member to the use of TRFC facilities during all normal opening hours.  ‘3 Months Pay Monthly’ membership is a binding commitment by the Member to remain a Member for at least 3 months.  The Member cannot cancel this Contract during the first 3 months.  At the end of the first 3 months this Contract will continue to run on a monthly basis at the prevailing ‘3 Months Pay Monthly’ membership rate.  Should The Member wish to cancel this Contract after the minimum period of 3 months, The Member must provide one month’s advance written notice which may be submitted to TRFC at the end of the first 2 months, effective from the first day of the next full month. 

b)     ‘6 Months Pay Monthly’ memberships entitle the Member to the use of TRFC facilities duringall normal opening hours.  ‘6 Months Pay Monthly’ membership is a binding commitment by the Member to remain a Member for at least 6 months. The Member cannot cancel this Contract during the first 6 months.  At the end of the first 6 months this Contract will continue to run on a monthly basis at the prevailing ‘6 Months Pay Monthly’ membership rate.  Should The Member wish to cancel this Contract after the minimum period of 6 months, The Member must provide one month’s advance written notice which may be submitted to TRFC at the end of the first 5 months, effective from the first day of the next full month. 

c)     ‘12 Months Pay Monthly’ memberships entitle the Member to the use of TRFC facilities during all normal opening hours.  ‘12 Months Pay Monthly’ membership is a binding commitment by the Member to remain a Memberfor at least 12 months.  The Member cannot cancel this Contract during the first 12 months.  At the end of the first 12 months this Contract will continue to run on a monthly basis at the prevailing ‘12 Months Pay Monthly’ membership rate.  Should The Member wish to cancel this Contract after the minimum period of 12 months, The Member must provide one month’s advance written notice which may be submitted to TRFC at the end of the first 11 months, effective from the first day of the next full month. 

d)     ‘Pay In Advance 3 Months’ Membership entitles the Member to the use of TRFC facilities during all normal opening hours.  ‘Pay In Advance 3 Months’ Membership is a binding commitment by the Member to remain a Member for at least 3 months.  The Member cannot cancel this Contract during the first 3 months.  At the end of the 3 month Membership period this Contract will expire. 

e)     ‘Pay In Advance 6 Months’ Membership entitles the Member to the use of TRFC facilities during all normal opening hours.  ‘Pay In Advance 6 Months’ Membership is a binding commitment by the Member to remain a Member for at least 6 months.  The Member cannot cancel this Contract during the first 6 months.  At the end of the 6 month Membership period this Contract will expire.   

f)     ‘Pay In Advance 12 Months’ Membership entitles the Member to the use of TRFC facilities during all normal opening hours.  ‘Pay In Advance 12 Months’ Membership is a binding commitment by the Member to remain a Member for at least 12 months.  The Member cannot cancel this Contract during the first 12 months.  At the end of the 12 month Membership period this Contract will expire.

g)     ‘Off-Peak Pay Monthly’ Membership entitles the Member to only use the Club's facilities during the allotted "Off-Peak" times which are as follows:

Monday to Thursday, between 6am and 4pm only.

Friday, between 6am and 10pm only.

Saturday to Sunday, between 9am and 2pm only.

Management have the right to withdraw the ‘Off-Peak Pay Monthly’ Membership if the Member is found using the Club's facilities outside “Off-Peak” times.  ‘Off-Peak Pay Monthly’ Membership is a binding commitment by the Member to remain a Member for at least 3 months.  The Member cannot cancel this Contract during the first 3 months.  At the end of the first 3 months this Contract will continue to run on a monthly basis at the prevailing ‘Off-Peak Pay Monthly’ Membership rate.  Should The Member wish to cancel this Contract after the minimum period of 3 months, The Member must provide one month’s advance written notice which may be submitted to TRFC at the end of the first 2 months, effective from the first day of the next full month.

h)     ‘Pay In Advance Off-Peak’ Membership entitles the Member to only use the Club's facilities during the allotted "Off-Peak" times which are as follows:

Monday to Thursday, between 6am and 4pm only.

Friday, between 6am and 10pm only.

Saturday to Sunday, between 9am and 2pm only.

Management have the right to withdraw the ‘Pay In Advance Off-Peak’ Membership if the Member is found using the Club's facilities outside “Off-Peak” times.  ‘Pay In Advance Off-Peak’ Membership is a binding commitment by the Member to remain a Member for at least 3 months.  The Member cannot cancel this Contract during the first 3 months. At the end of the 3 month Membership period this Contract will expire.

i)     ‘Weekend Pay Monthly’ Membership entitles the Member to only use the Club's
facilities during the allotted "Weekend" times which are as follows:

Friday, between 6am and 10pm only.

Saturday to Sunday, between 9am and 2pm only.

Management have the right to withdraw the ‘Weekend Pay Monthly’ Membership if the Member is found using the Club's facilities outside “Weekend” times.  ‘Weekend Pay Monthly’ Membership is a binding commitment by the Member to remain a Member for at least 3 months.  The Member cannot cancel this Contract during the first 3 months. At the end of the first 3 months this Contract will continue to run on a monthly basis at the prevailing ‘Off-Peak’ membership rate.  Should The Member wish to cancel this Contract after the minimum period of 3 months, The Member must provide one month’s advance written notice which may be submitted to TRFC at the end of the first 2 months, effective from the first day of the next full month.

j)     ‘Pay In Advance Weekend’ Membership entitles the Member to only use the Club's
facilities during the allotted "Weekend" times which are as follows:

Friday, between 6am and 10pm only.

Saturday to Sunday, between 9am and 2pm only.

Management have the right to withdraw the ‘Pay In Advance Weekend’ Membership if the Member is found using the Club's facilities outside “Weekend” times.  ‘Pay In Advance Weekend’ Membership is a binding commitment by the Member to remain a Member for at least 3 months.  The Member cannot cancel this Contract during the first 3 months. At the end of the 3 month Membership period this Contract will expire.

k)     Full details of normal opening hours together with a schedule of charges and fees are available upon request at TRFC club.

l)     The Management of each Club reserves the right to vary normal opening hours as well as “Off-Peak” and “Weekend” times and to introduce, withdraw and vary categories of membership from time to time.  In each case TRFC will provide at least one months notice of such changes, such notice to be displayed at the affected club(s).

4. Cancellation

a)     14 day money back guarantee:

If a member for any reason is dissatisfied with the service offered by TRFC they are entitled within the first 14 days of their membership to a refund of their joining fee and any monthly fees paid.

b)     Any ‘Pay In Advance’ or ‘Pay Monthly’ Member can cancel his/her Membership after the core period of continuous Membership by giving one month's advance notice in writing to “the Management”.  As Membership is a contracted commitment to membership for a minimum period of 3, 6 or 12 months (depending on the Membership Type respectively), the Member cannot cancel this Contract during the contracted minimum period as governed by the Membership Type.  

c)     Where the chosen method of payment for monthly dues is direct debit, it is the responsibility of the Member wishing to cancel his/her membership to instruct his/her bank in writing to cancel the monthly direct debit.  All subscriptions and dues must be fully paid up to date including the appropriate notice period at the time of cancellation. TRFC is not obliged to refund any membership dues where the Member has not cancelled their direct debit instruction with their bank in accordance with this clause and does not hold acknowledgement of membership cancellation by their Home Club.

d)     Where the chosen method of payment for monthly dues is recurring credit card, the Member can only cancel their membership by written notification to TRFC.  The member must hold written acknowledgement of membership cancellation by their Home Club.

5. Membership Card

a) Upon acceptance by TRFC of the Member's application and payment by the Member of the Joining Fee and Administration Fee, the Member will be issued with a membership card and the Member shall be entitled to all the rights and privileges exercisable by the type of membership for which his/her application has been accepted.

b) There is a fee as set out in the relevant then current Club price list for replacement of lost, stolen or damaged cards.

c) Members must have his/her card swiped for security and verification on each visit to the Club before proceeding into the Club.  Any Member attending a Club without a valid Membership Card may be asked for proof of identification.

d) A Member must not lend his Membership Card to anyone else as Membership is personal and covers only the Member’s use of a Club.

e) On termination of Membership for any reason, the Member is required to surrender his Membership Card to TRFC at his/her Home Club.

f) Where TRFC terminates a Member’s Membership, this will make the Member ineligible for Membership of all TRFC Clubs, for which purpose TRFC will communicate such of the Member’s personal data and reason for termination to such other Clubs as may be necessary to administer this Rule.

g) Any Member wishing to enter any TRFC club without a valid membership card will only be admitted at the absolute discretion of the Management.

6. Initial Joining Fee and Membership Dues

a) All Members shall pay an initial joining fee or Administration Fee of the sum specified by TRFC and stated on the Membership Application Form, before being issued with a membership card.  The fee is not refundable under any circumstances.

b) Membership is payable in advance either monthly, quarterly, semi-annually or annually (please see paragraph 3 above "Membership Types"). In the event that the Member falls into arrears in respect of any fees or dues payable TRFC reserves the right to levy an administration charge of £25 for each such event.

c) Membership dues for monthly Members may be increased at the discretion of and at any time by TRFC, subject to at least one calendar months’ notice.

d) Where the monthly payment method is direct debit, if the Member fails to pay any monies due under this Contract or if any Direct Debit is returned unpaid or any cheque is returned unpaid or if any other form of payment is not honoured for whatever reason, the Member shall pay TRFC on demand an administration fee of £25.

e) Where the monthly payment method is direct debit, the Member is obliged to make the minimum number of Direct Debit payments as stated on the Membership Application Form with the first one being paid on the 1st Direct Debit Payment Date and then every month thereafter.  For the avoidance of doubt, the Member is obliged to make every Direct Debit Payment regardless of non attendance, whatever the reason for non attendance may be.

f) The Member agrees to advise TRFC immediately of any change to the Members’ personal details or billing address or home address or the bank account details provided on the Membership Application Form.

g) If the Member fails to pay any amount due under this Contract for a period of more than thirty days, then TRFC may pass the debt to a third party company for collection.  The reasonable costs incurred in employing the third party company will be borne by the Member including costs in tracing the Member should the Members have changed his/her address without telling TRFC.

h) In order to extend Membership after completing the Minimum Number of Direct Debit Payments, TRFC automatically continue collecting the Direct Debit Payment amount every month.  Membership will be extended by one month each payment.  Each payment made is not refundable under any circumstances. This Renewal Direct Debit Payment amount may only be amended if TRFC advise the Member in writing giving 30 days notice.  Please note – If Membership included the benefit of a Free Period then TRFC will stop making collections during that Free Period and recommence making collections on the Renewal Date.

i) During this Renewal Period the only way the Member can cancel his/her Membership is by cancelling his/her Direct Debit Mandate directly with his/her Bank.

7. "Freezing" Memberships

a) A Member may apply for their membership to be "frozen", subject to paragraph 7(c) below, in which case the membership may be extended for a period equivalent to the "frozen" period with an additional fee payable at the then current monthly rate.  The expiry date of the initial fixed term of a “Pay Monthly” membership will be extended by the number of months the membership is "frozen".

b) One calendar months’ notice of "freezing" must be given in writing to the Member's Home Club and must be for a minimum period of three months and a maximum period of one year.  Monthly membership may not be "frozen" during the notice period in respect of the cancellation of membership (please see paragraph 4 above "Cancellation").

c) "Freezing" will only be approved for genuine reasons of illness, injury, pregnancy or temporary employment relocation.  Appropriate written evidence from the Member's doctor or employer is required to support the application to "freeze".

8. Limitation of Liability

a) In consideration of TRFC accepting their application for membership of the Club, and for he/she becoming and remaining a Member of the Club, the Member agrees that:

(i) Neither TRFC, nor its employees or agents shall be liable for any loss, damage or theft of any property belonging to, or brought onto any TRFC club premises by the Member or any guest of the Member, occurring upon any TRFC club premises unless, subject to paragraph 8b below, such loss, damage or theft was caused by negligence of TRFC, or its employees, agents or sub -contractors.

(ii) Neither TRFC, nor its employees or agents shall be liable for any death, personal injury or illness occurring upon any TRFC club premises or as a result of the use of the facilities and/or equipment provided by any TRFC club, except to the extent that such death, personal injury or illness arises from any negligent act or omission of TRFC or its employees, agents or sub-contractors.

b) Without prejudice to paragraph 8a above, it is the Member's responsibility to ensure that he/she correctly operates or uses any facilities and/or equipment provided by any TRFC club, including the adjustment of levels or settings on the equipment.  If the Member is in any doubt as to how to correctly operate any equipment he/she should consult a member of staff before use.

9. Physical Condition of Member

a) The Member warrants and represents on the date of his/her application and repeats such warranty and representation each time he/she uses the TRFC facilities that he/she is in good physical condition and that he/she knows of no medical or other reason why he/she is not capable of engaging in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition.

b) TRFC staff are not medically trained and are therefore not qualified to assess whether the Member or any guest is in good physical condition and/or that he/she can engage in active or passive exercise without detriment to his/her health, safety, comfort or physical condition.  TRFC strongly advise all Members and guests to take expert medical advice prior to commencing any exercise programme if they are in any doubt about their ability to engage in active or passive exercise.

c) The Member shall not use any TRFC club facilities whilst suffering from any infections or contagious illness, disease or other ailment or whilst suffering from any physical ailment such as open cuts, abrasions, open sores or minor infections where there is a risk, however small, that such use may be detrimental to the health, safety, comfort or physical condition of the other members or their guests or TRFC staff.

10. Gymnasium Use

a) Members must complete a Pre-Activity Health Questionnaire before using any facility of a Club.

b) Members should seek instruction before using unfamiliar equipment.

c) Members may not bring their own Personal Trainers into a Club.

d) Appropriate clean exercise clothing and shoes must be worn whilst exercising.

e) Members are asked to wipe down gymnasium equipment after use.

f) Members are asked to arrive at the gymnasium five (5) minutes prior to any personal training or induction appointment.  TRFC reserve the right to: refuse to re-book an appointment for any Member if he/she repeatedly cancels (with less than 24 hours notice) or fails to keep an appointment for services and/or exercise programmes.

g) Members may not use the gymnasium whilst under the influence of alcohol or anticoagulant, antihistamines, beta-blockers, narcotics, or tranquillisers.  If a Members has high or low blood pressure, heart disease and/or diabetes he/she should consult his/her doctor prior to using a Club.

11. Guests And Visitors

a) Members may bring guests over the age of 18 to a Club upon payment of:

(i) the guest fee as set out in the relevant Club price list current at the time of the guest’s visit charged by the Club; and

(ii) completion of a Pre-Activity Health Questionnaire by the guest.

b) Members must accompany their guest at all times and the Member who brings the guest remains responsible for their guest’s conduct whilst they are in the Club.  The Member may not leave that Club prior to their guest’s departure.

c) Certain former Members, persons who have applied for Memberships but have been rejected and former Members of staff may be ineligible to be a Member, or guest, of a Club.  If in doubt, the Member should check with the Management for advice.

d) A Member who has "frozen" his/her Membership will not be allowed access to any Club (including as a guest).

e) Members must ensure their guests pay the appropriate guest fee or surrender a valid guest pass (if applicable) before accompanying them into a Club.

f) Members must ensure that their guests comply with the rules of this Contract.

g) A person may be allowed to enter as a visitor to a Club by prior arrangement/appointment subject to TRFC’s absolute discretion and may be required to pay the visitor fee as set out in the relevant Club price list current at the time of visit and at all times must complete a Pre-Activity Health Questionnaire.

12. Classes

a) Members and Guests may need to pre-book some classes to ensure participation in them.

b) Class schedules and instructors are subject to change from time to time without notice.

c) In order to avoid disturbing classes, Members and Guests are requested to arrive in good time.  Entrance to classes will be barred to anyone arriving more than five (5) minutes late.

d) Where, in the opinion of an instructor, a class is overcrowded, the instructor may restrict the number of attendees at that class.

e) An instructor may, at any time, ask you to leave a class if you are jeopardising the safety or enjoyment of others.

f) TRFC reserve the right to limit you to participating in only one exercise class per day.

13. Unlimited Personal Training

a) Wherever “Unlimited Personal Training” is an inclusive part of Membership all personal training sessions are subject to the following rules:

(i) personal Training Sessions are limited to one session per day; and

(ii) members must book each session directly with the Club via the website or with reception no earlier than seven days and no later than three days in advance; and

(iii) in the event of a cancellation within 24 hours of the booked session, a cancellation fee of £25 will apply per session; and

(iv) each personal training session is limited to one hour per operational day.

14. Expulsion of Members and Termination of Membership

a) TRFC may terminate the membership of any Member, providing written notice of reasons for termination within a reasonable period from date of termination if not provided to the Member in writing at the time of termination:

(i) without notice and with immediate effect if the Member's conduct, whether or not such conduct is the subject of complaint by another member or members, is such that in the reasonable opinion of the Management, it may be injurious to the character or interests of any Club, or is such that it renders the Member unfit to associate with other members of any club;

(ii) without notice and with immediate effect if the Member shall have committed any breach of the terms and conditions or of this Contract from time to time in force;

(iii) without notice and with immediate effect, if any fees or dues payable under this Contract remain unpaid after the due date for payment; and

(iv) upon notice in writing and with immediate effect, if TRFC is of the opinion that, the Member is not a suitable individual for continued membership of the Club.

b) All decisions of the Management under this clause are final and binding.

c) A Member whose membership is terminated by TRFC under the provisions of Clause 14(a) shall forfeit all the privileges of membership with immediate effect without entitlement to any refund of his/her initial joining fee or monthly or quarterly or semi-annual or annual membership charges and shall remain liable for any outstanding membership dues or initial joining fee which remain due and owing to TRFC at the date of termination of membership.  On termination of his/her membership, the Member shall immediately return his/her membership card and any other evidence of membership provided to that Member by the Club and shall be prohibited from Membership of any other of TRFC clubs.

d) Any lapses in membership, including but not limited to the nonpayment of monthly membership dues or failure to renew monthly, quarterly, semi-annual or annual membership, may result, at TRFC s discretion in the current joining fee and administration fee being charged should the member reapply for membership.

15. Conduct

a) Members and Guests should use the equipment and facilities in accordance with the advice given by any TRFC staff and/or by notices suitably posted.  Members and guests shall not abuse the equipment or facilities of any Club and any Member or Guest who willfully or negligently causes such damage shall pay for any damage to any club property.

b) Disorderly, rude or offensive behavior towards any TRFC member of staff or other Members will result in the immediate termination of the Member's membership.  For the purpose of this rule a single breach will be regarded as "serious".

c) Members and Guests should conduct themselves in a quiet and well-mannered fashion when in or about a Club and in a manner that will not disturb or impair the use and enjoyment of that Club by any other person.  In particular Members and Guests may not use foul, loud or abusive language, nor will they molest or harass other Members, guests, visitors or Members of staff.  Members and Guests may not bring, use or be under the influence of illegal drugs in any part of a Club.  Members and Guests may not bring any intoxicating liquor into a Club or be drunk in a Club.

d) TRFC may terminate any Membership (if applicable) and may refuse entry into a Club or eject Members from a Club if he/she commits a serious or repeated breach of this Membership Contract or Members engage in any other serious misconduct.

e) Members, their guests and visitors and members of staff should at all times display mutual respect for each other.

f) Complaints should be communicated either privately or in writing via email or by post to the Management.

g) Smoking is prohibited in all areas of a Club.

h) Members must be dressed in suitable attire at all times when on Club premises and appropriate exercise clothing is required whilst exercising in the Club. Guidance as to suitable attire may be obtained from the Management who may, at his/her discretion, require you to leave the Club premises or part of the Club premises, if your attire is not considered suitable.

i) Only one individual is permitted in a shower cubicle at any one time.

16. Lockers

a) Lockers are made available subject to availability. Members must provide their own padlocks and lock his/her locker whilst in use, both for security, and to show other people that the locker is occupied.  TRFC does not undertake that use of a locker will guarantee that no theft of or damage to Members’ property will occur.  Members should check that his/her household contents or other insurance policy protects against any risk of theft.

b) Lockers may only be used for the purposes of keeping gym kit, toiletries and the clothing that Members were wearing when entering the Club. The keeping of any other items in the Club’s lockers is prohibited. If TRFC has reasonable grounds to suspect that a locker is being used in breach of this Contract, TRFC reserves the right to open the locker in question (by force if necessary) and remove any offending items.

c) With the exception of any designated private lockers, lockers are available for use only whilst Members are on the Club’s premises.  Use of a locker (other than any designated private lockers) whilst not on the Club’s premises is prohibited.  If Members leave his/her belongings overnight in a locker (other than in any designated private locker), TRFC reserves the right to open the locker (by force if necessary) and remove the Members’ belongings.

d) Members belongings so removed will be available for collection from the Club’s reception for a period of thirty (30) days upon payment of the prevailing holding charge.  If Members do not collect his/her belongings within thirty (30) days, the belongings may be donated to charity.

e) If Members rent a designated private locker (if available), and if the rental fees in respect of that locker remain unpaid for more than one (1) month after the date due for payment, TRFC reserves the right to open the locker (by force if necessary) and remove the Members belongings. The belongings so removed will be available for collection from the Club’s reception for a period of thirty (30) days upon payment by the Member of the unpaid fees and the reasonable prevailing administration charge.  If Members do not collect his/her belongings within thirty (30) days, his/her belongings may be donated to charity.

f) Where available lockers and locker keys remain the property of the Club and locker keys must not be taken from the Club’s premises at any time.

17. Steam Room

a) For reasons of health and hygiene Members must:

(i) obey the instructions of TRFC staff;

(ii) always shower before entering the steam room;

(iii) not consume or store, or bring into the changing rooms or steam room, any food or drink or any kind of glass container; and

(iv) only shave in the wash basins provided.

b) The Management reserves the right to limit Members to 20 minutes in the steam room if it is busy.

c) Members may not use the steam rooms whilst under the influence of alcohol or anticoagulant, antihistamines, beta-blockers, narcotics, or tranquillisers. If Members have high or low blood pressure, heart disease, cardiac irregularities, asthma and/or diabetes and if she is pregnant Members should consult his/her doctor prior to using the Club facilities.

d) Members should use the steam room in moderation and under medical advice.

e) When using the steam room, Members are requested to wear swimming attire.

18. Other

a) Upon joining the Club the Member consents to having his/her photograph taken by TRFC at any time whilst using the TRFC facilities and the Management reserves the right to use any such individual or group photographs of members and/or guests for press or promotional purposes.

b) Members and their guests are asked to store personal belongings in the lockers provided.  Lockers are provided on a daily basis or can be hired for a month or a year.  Items left overnight in lockers hired for one days use will be removed from the lockers and retained for a reasonable period of time appropriate to their value and will subsequently be disposed of by the Management.  Management reserves the right to levy a fee, at the current rate, for unauthorized overnight usage of lockers.

c) Each club's normal hours of operation and the hours in which any facilities within that club are available to members are obtainable from that club upon request.  The Management however reserves the right temporarily to close certain areas of any club from time to time without notice for the purpose of cleaning, decorating, repairs or for special functions and holidays.

d) The failure of the Management or TRFC to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights, neither shall any failure to identify or act upon a breach of the terms of this Contract by Members be deemed to be an affirmation by the Management and/or TRFC that the behavior of the Member or their guest is acceptable.

e) Where a provision is deemed to be invalid or unenforceable by the courts the provision will be deleted from this Contract but such deletion will not affect the validity and enforceability of the remaining provisions.  Membership is personal to the Member and cannot be transferred to any other person.  TRFC may assign or transfer the benefit of this Contract, or sub-contract its obligations under it, to any person, firm or company at any time without notice to the Member but shall remain primarily liable to meet its obligations to the Member under this Contract unless the Member agrees otherwise.

j) Where TRFC is required to provide written notice to the Member under this Contract, TRFC will send the notice to the address appearing on the Membership Application Form or such other address as the Member shall notify to TRFC in writing from time to time.  It is the responsibility of the Member to inform TRFC promptly of any change of the Member's address.  Any notice sent by TRFC in accordance with this clause will be deemed received by the Member two days after the date of dispatch.

k) Where TRFC is required to give notice to the Member under this Contract but the notice is not specified to be required in writing, appropriate notice shall be deemed to have been given to the Member if TRFC places notice in prominent positions within the Club or clubs (as appropriate).

l) Where the Member is required to give written notice to TRFC under this Contract, the Member must send the notice to the Club Manager at the Member's Home Club.

19. Health and Safety

a) Members and Guests must use the main entrance to a Club when entering or leaving that Club.

b) Fire exits, which are clearly marked, are there in the interests of safety and Members and Guests must not interfere with fire doors for any reason.

c) Members and Guests must read the health and safety notices posted outside any equipment or facility in a Club and comply with their recommendations.

20. General

a) If TRFC take no action or let the Member off any breach of this Contract or give the Member extra time to pay or comply, it will not stop TRFC from enforcing the terms of this Contract strictly at a future date.

b) TRFC may assign the benefit of this Contract and TRFC’s rights thereunder to a third party on notice to the Member.  The Members’ rights under this Contract will not be prejudiced.

c) Except where permitted by this Contract, neither TRFC nor the Member may alter the terms of this Contract without the express agreement of the other.

d) Opening times for a Club will be prominently displayed at the relevant Club.

e) Members are respectfully requested to leave the gymnasium and boxing training areas half an hour before the Club is due to close and to leave the Club premises punctually at time of closing.

f) Members may not bring pets (other than guide dogs) onto the Club premises.

g) Members must not take any photographs or movie shots in any Club (including by using a camera on a mobile phone or PDA).

h) Members must not consume any food or drink in a Club that he/she have bought in from outside the Club.

i) TRFC reserve the right to show potential Members and other individuals the facilities of a Club on a trial basis.

j) This Contract will be subject to English Law and the Courts of England will have jurisdiction over any disputes in relation to it.
